For those with a brain injury, capacity to marry is not a welfare test so it is unnecessary to consider whether the marriage will bring happiness, whether it is a wise decision, or whether the marriage is likely to last. The approach of the Court of Protection tends to be to avoid an overly paternalistic approach and instead to respect the right to a private life for adults with cognitive impairments.

In this feature, Alison Taylor interviews Adrian Mundell on the controversial judgment of Mundell v Name 1, 2019, providing background to the case and an explanation of what steps were taken to protect his client who was in a volatile abusive relationship.

I initially joined Frenkel Topping in 2006 as a senior consultant, switching in 2009 to focus on expert witness work and training. My new role saw me increasingly writing and speaking at conferences and seminars for personal injury lawyers and becoming more of a mentor for less-experienced consultants.

As head of training, I play a key role in Frenkel Topping’s business development activities including researching, updating, writing and delivering training presentations for the FT Knowledge Hub. I also speak at external seminars and conferences and support consultants with their account development needs and technical knowledge. I am responsible for the organisation of the programme for the annual, flagship FT Deputy Day and have my own specialist expert witness practice for catastrophic injury cases.

Daniel qualified as a music therapist in 2002. His work focused on children and families, especially supporting attachment, bonding and resilience. Daniel has worked in prisons, mental health settings and in special and mainstream schools with children with a range of brain injuries and other conditions.

He is certified in the APCI assessment in 2014, and as a Neurologic Music Therapist in 2017. He leads a team of 70+ creative arts therapists working across the UK in healthcare, education and social care settings.

His Honour Judge Allan Gore QC was called to the Bar in 1978 and took silk in 2003 specialising in personal injury and clinical negligence claims. In 2010, he was appointed as a Circuit Judge, and was authorised to sit as a Deputy High Court Judge.

He was appointed Senior Circuit Judge in 2011, and became Designated Civil Judge for Merseyside, then Designated Civil Judge for Greater Manchester in 2013 and now for Devon and Cornwall in 2017 including Dorset since 2021. He values his position as a trustee for the Frenkel Topping Charitable Foundation, helping to lead the charity and bringing to that role his long experience of the effects of serious injuries not only on those who suffer them but also their families and the many who support and care for them.

I joined Frenkel Topping in 2010 and have since risen through the ranks to my current position as group commercial director and managing director for both Frenkel Topping Limited and Obiter Wealth Management. I am head of the company’s litigation support team and am the company’s lead expert for periodical payments/structured settlements, with industry-wide recognition.

I hold a degree in mathematics and accounting, am authorised and regulated by the Financial Conduct Authority and currently hold the Statement of Professional Standing issued by the London Institute of Banking & Finance. I have also studied and successfully qualified in the investment advice certificates and have a great understanding of holistic financial planning.

I have worked in the financial services industry since 1996. I began my career at Nelson’s Money Managers before joining Barclay’s Financial Management in 1998. Immediately prior to joining FT I was managing director of my own IFA firm, which I ran successfully for several years.

Norma joined Frenkel Topping in 1998, working her way up to Technical Support Manager until she retired in 2015. She retired early as her mother was sadly poorly with Alzheimers, and passed that year.

Norma then became a carer, along with her sister, for their father until he passed in 2018. She was delighted to be asked if she would be a Trustee and Charity Manager for the Foundation in 2019, as she wanted to do something rewarding.

In her role as Charitable Manager and Trustee, Norma has been investing her time and energy into relaunching and re-establishing the Foundation.

Paul’s career in costs started out in October 2002, where he worked as a costs negotiator dealing with personal injury matters. His interest in Court of Protection matters began in 2006 when he worked in house for two panel deputies. The following years saw Paul building up a case load of over 70 clients nationwide.

Paul enjoys working with clients by providing them with in house training, advice and ongoing guidance and assistance as to how they can adapt their working practices to ensure the best result at assessment is achieved. Sam Elsby qualified as a solicitor in 1984. He has undertaken personal injury work only since 1990, when he also joined APIL. For over ten years, Sam was a partner at general practice high street firm in Eastbourne, before leaving to set up his own practice in early 2003.

In February 2018 his firm merged with Dean Wilson LLP in Brighton, where he joined their personal injury and clinical negligence team as a consultant. He takes on a wide range of cases, both by reference to value and cause of action. He has particular expertise in child/adolescent brain injury cases; fast-track trial advocacy and Inquests. He is also a Court of Protection Deputy.

Sam was the south east regional co-ordinator of APIL for 9 years. He is a Fellow of APIL and was elected as vice-president in May 2019 and was APIL president for the year 2020/2021.
